This was an appeal from the approval of a class action settlement agreement related to the Secretary of the Interior's breach of duty to account for funds held in trust for individual Native Americans. The court concluded that the record failed to confirm either the existence of a purported intra-class conflict or a violation of due process. Rather, the record confirmed that the two plaintiff classes possess the necessary commonality and adequate representation to warrant certification, and that the district court, therefore, did not abuse its discretion in certifying the two plaintiff classes in the settlement or in approving the terms of the settlement as fair, reasonable, and adequate pursuant to Rule 23(e). This case arose when plaintiff filed a putative class action in Texas state court alleging that defendants had violated certain provisions of the Texas Education Code by soliciting students in Texas without the appropriate certifications. Defendants subsequently appealed the district court's confirmation of an arbitral award that required them to submit to class arbitration. They contended that the district court, not the arbitrator, should have decided whether the parties' agreement provided for class arbitration, and that the district court should have vacated the arbitrator's class arbitration award. Because the parties agreed that the arbitrator should decide the class arbitration issue, the court concluded that the district court correctly referred that issue to the arbitrator. The district court erred, however, in confirming the award because the arbitrator exceeded his powers. Therefore, the court reversed and remanded for further proceedings. View "Reed v. Plaintiffs installed shingles manufactured by Owens Corning (debtor). They discovered leaks in 2009; shingles had cracked. Each sent warranty claims, which were rejected. They filed a class action alleging fraud, negligence, strict liability, and breach of warranty. In 2000, the debtors had filed Chapter 11 bankruptcy petitions; the Bankruptcy Court set a claims bar date in 2002 and approved a notice that appeared in multiple publications. Notices of the confirmation hearing for the Plan, in 2006, included generic notice to unknown claimants. At the time they filed the class action plaintiffs did not hold “claims” under 11 U.S.C. 1101. The Third Circuit subsequently established a rule that a claim arises when an individual is exposed pre-petition to a product or other conduct giving rise to an injury, which underlies a right to payment under the Bankruptcy Code. Based on that holding, the district court held that plaintiffs’ claims were discharged. The Third Circuit affirmed in part and remanded, agreeing that plaintiffs had “claims.” Both were “exposed” to the product before confirmation of the plan. Plaintiffs were not afforded due process by published notice, however, because they could not have known they had claims at the time of confirmation. View "Wright v. Owens Corning" on Justia Law

E-Shops filed a class action complaint, after receiving a number of chargebacks resulting from fraudulent use of U.S. Bank credit cards, alleging that U.S. Bank knowingly allowed itself to be an instrument of the fraud, thereby making E-Shop's performance under its contract with its merchant bank more expensive. The district court dismissed E-Shops complaint for failure to state a claim. The court affirmed, holding that E-Shops failed to satisfy the required pleading standards. View "E-Shops Corp. v. Plaintiffs brought a class action on behalf of themselves and others who purchased houses from a builder, Ryland, in the Newport subdivision of Vista Lakes, a residential development in Orlando, Florida. The Newport subdivision was adjacent to land known as "Pinecastle." Pinecastle was used as a bombing range during World War II and remained laden with, among other things, unexploded bombs. When plaintiffs bought houses from Ryland, they were unaware of Pinecastle. Later, after Pinecastle's existence became public, plaintiffs' houses lost considerable market value and plaintiffs brought this lawsuit to compensate for the loss. Counts 1, 3, and 4 sought compensation for the loss of value plaintiffs' houses sustained due to their close proximity to Pinecastle. Count 2 sought recovery of 1.5 percent of the purchase price of every home Ryland sold in the Newport subdivision. The court affirmed the district court's dismissal of Counts 1 and 2 with prejudice and Count 3 without prejudice, pursuant to Rule 12(b)(6). A taxpayer class filed an illegal-exaction complaint. The case was remanded for the circuit court to ascertain a remedy consistent with the Supreme Court's decision that the taxpayers had proved a valid claim for illegal exaction of increased ad valorem library taxes for the 2007 ad valorem tax year. In this appeal, the taxpayers contended that the circuit court erred in applying the voluntary-payment rule to class members who paid the tax in question prior to the date the complaint for illegal exaction was filed. The Supreme Court dismissed the appeal without prejudice, holding that the order appealed was not a final order and did not contain specific factual findings of any danger of hardship or injustice that could be alleviated by an immediate appeal, and therefore, the Court lacked jurisdiction over the appeal. OneBeacon and AMICO were insurers of the B.F. Goodrich and, among others, were liable for environmental cleanup at the Goodrich plant in Calvert City, Kentucky. AMICO settled with Goodrich, but OneBeacon’s predecessor went to trial. A state court jury found for Goodrich, and OneBeacon was ordered to pay $42 million in compensatory damages and $12 million in attorney fees. The state court also denied OneBeacon's request for settlement credits to reflect amounts paid by other insurers, such as AMICO, through settlements with Goodrich. OneBeacon sought equitable contribution; AMICO removed to federal court. The district court granted AMICO summary judgment. The Sixth Circuit affirmed. Ohio policy favoring settlements provides that a settled policy is exhausted for purposes of equitable contribution; the court declined to address whether Ohio law permits interclass contribution actions or whether the jury finding of bad faith bars equitable relief. Plaintiffs, a putative nationwide class of third-party payors and a putative nationwide class of individual patient-consumers who paid for prescriptions, sued pharmaceutical manufacturers alleging that they paid for oncology and hepatitis drugs that were ineffective or unsafe for the off-label uses for which they were prescribed and that defendants pursued illegal marketing campaigns to persuade physicians to prescribe the drugs for those uses. While physicians are not prohibited from prescribing drugs for off-label uses, manufacturers are generally prohibited by the Federal Food, Drug and Cosmetic Act, 21 U.S.C. 301, from manufacturing, marketing, or selling for off-label use. Defendant had pled guilty to a criminal charge brought by the FDA and agreed to pay fine of $180 million and to pay $255 million to resolve civil claims that it defrauded Medicare, Medicaid, and the VA. The district court dismissed, for lack of standing, claims under the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. 1961, the New Jersey RICO statute, N.J.S. 2C:41-1, and other state statutory and common law causes of action. The Third Circuit affirmed, finding that plaintiffs failed to establish a causal connection between the alleged misconduct and the alleged harm. View "In Re: Schering Plough Corp." on Justia Law

This case involved two putative class actions, consolidated on interlocutory appeal, brought by purchasers of real estate brokerage services in South Carolina. Each complaint alleged that the real estate brokerages serving as board members of the local multiple listing service (MLS) conspired to unfairly restrain market competition in violation of section 1 of the Sherman Antitrust Act, 15 U.S.C. 1. The court held that plaintiffs sufficiently pled the plurality of actors necessary for section 1 to apply. At this early stage of the litigation, the court was not in a position to weigh the alleged anticompetitve risks of the MLS rules against their procompetitive justifications. This rule of reason inquiry was best conducted with the benefit of discovery and the court expressed no view on the merits of the litigation beyond recognizing the sufficiency of the complaints. The Telephone Consumer Protection Act, 47 U.S.C. 227, curtails use of automated dialers and prerecorded messages to cell phones, whose subscribers often are billed for the call. AT&T hired a bill collector to call cell phone numbers at which customers had agreed to receive calls. The collection agency used a predictive dialer that works autonomously until a human voice answers. Predictive dialers continue to call numbers that no longer belong to the customers and have been reassigned to individuals who had not contracted with AT&T. The district court certified a class of individuals receiving automated calls after the numbers were reassigned and held that only consent of the subscriber assigned the number at the time of the call justifies an automated or recorded call.
